Why you should use a process server

There are several reasons why you might require the services of a process server, for instance to serve a Statutory Demand, Injunction Order, Winding-up petition or a host of other legal documents.

Process serving makes up a significant proportion of our work as private investigators and requires an assortment of investigative tasks, such as filing court papers, tracing individuals, serving legal documents and document retrieval.

Our principal job is to deliver or ‘serve’ documents in a timely manner and provide evidence that the papers were served, in the form of a certificate, statement or affidavit of service to the individual or company who has instructed us – in most cases this would be a solicitor.

If you require documents to be served, you will likely need to appoint a professional process server to do this for you, as the recipient may be difficult to find or maybe evading service, and often these important documents need to be served in time for a court date; which could be the next day.

Here are some of the reasons why you should use a process server:

  • Process servers are instructed to hand-deliver important documents to any individual, or company; these documents cannot just be posted, because the recipient could simply ignore them or claim they haven’t received them.

  • The person you are trying to serve could be illusive or go into hiding and it is important that the documents are served in a timely and appropriate manner.

  • Process servers will work 24/7 to get your documents served and often know the optimum times to deliver the documents and get the results you want.

  • A process server must provide ‘proof of service’ to demonstrate to the individual or company that the documents have been served as instructed to the correct recipient in a timely manner.

  • We have methods, resources and experience in tracking down and engaging individuals who may be difficult to find. 

  • We are trained in handling situations that might get difficult, such as visiting deprived areas and neighbourhoods, encountering aggressive individuals and being threatened.

  • There are rules and legislation with regards to serving legal documents that process servers must adhere to.

  • Hiring a process server who is familiar with the area where the documents need to be served is more likely to provide an effective and quick service, as they know the neighbourhoods, including the road names, pubs, shops; anywhere where the individual could be located.

  • Process servers are discreet, professional and diligent and conform to the rules and regulations around data protection. We will only serve the legal document if we are 100% certain it is the correct individual.
